  • The Court or a Judge shall, upon application, unless good cause is shown to the contrary, award pre-judgment interest in accordance with s 51A of the Federal Court Act.
  • For pre-judgement interest under s 51A(1)(a), the Court will have regard to, in respect of the period from 1 January to 30 June and 1 July to 31 December in any year, the rate that is 4% above the cash rate last published by the Reserve Bank of Australia before that period commenced: paragraph 2.2, Interest on Judgments Practice Note (GPN-INT).

Note:
  • A judgment debt under a judgment of the Court carries interest from the date as of which the judgment is entered: s 52(1), Federal Court Act.
  • Post-judgment period is payable at the prescribed rate. That rate, for the periods from 1 January to 30 June and 1 July to 31 December in any year, is 6% above the cash rate last published by the Reserve Bank of Australia before the period commenced: s 52(2)(a), Federal Court Rules; r 39.06, Federal Court Rules.
  • However, if the Court, in a particular case, thinks that justice so requires— post-judgment interest may be calculated at such lower rate as the Court determines: s 52(2)(b), Federal Court Rules.
